FORECLOSURES NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF STEPHENS Under and by virtue of the power of sale contained in that certain Deed to Secure Debt and Security Agreement, dated January 30, 2006 (the “Original Security Deed”), from Currahee Partners, LLC, a Georgia limited liability company (“Currahee Partners”) and Currahee Partners II, LLC, a Georgia limited liability company (“Currahee Partners II”; Currahee Partners and Currahee Partners II collectively hereinafter referred to as “Grantor”) to National City Bank, a national banking association (“Original Lender”), recorded in Book 744, Page 247 with the Clerk of Superior Court, Stephens County, Georgia (the “Records”), as amended and modified by that certain Spreader and Modification to Deed to Secure Debt and Security Agreement, dated as of June 15, 2006 (the “Spreader”) from Grantor to Original Lender, recorded in Book 767, Page 73 in the Records, as assigned by Original Lender to Capstone Realty, Inc., an Ohio corporation (“Capstone”) pursuant to that certain Assignment of Deed to Secure Debt and Security Agreement and Other Loan Documents, dated as of July 30, 2009 and recorded on July 31, 2009 in Book 903, Page 440 in the Records, and as further assigned by Capstone to REAL PROPERTY HOLDING - TOCCOA, GA, LLC, a Delaware limited liability company (“Grantee”) pursuant to that certain Assignment of Deed to Secure Debt and Security Agreement and Other Loan Documents, dated as of September 2, 2009 and recorded on September 3, 2009 in Book 906, Page 337 in the Records (the Original Security Deed as amended and modified by the Spreader and as assigned, the “Security Deed”); said Security Deed having been given to secure the indebtedness evidenced by a Revolving Promissory Note dated as of January 30, 2006, made by Grantor to the order of Original Lender in the principal face amount of Twenty-Five Million and No/100 Dollars ($25,000,000.00), as amended and modified by that certain Allonge to Revolving Promissory Note dated effective as of May 1, 2008, as endorsed by Original Lender to Capstone by Allonge, dated July 30, 2009, and as further endorsed by Capstone to Grantee by Allonge, dated September 2, 2009 (as the same has been amended and modified and endorsed, the “Note”), there will be sold by Grantee, at public outcry, to the highest bidder for cash, before the door of the courthouse of Stephens County, Georgia, within the legal hours of sale on the first Tuesday in April, 2010, being April 6, 2010, the property conveyed by the Security Deed and being all of the following described land and interests in land, estates, easements, rights, improvements, property, fixtures, equipment, furniture, furnishings, appliances and appurtenances (hereinafter being referred to collectively as the “Property”): (a) The fee simple interest in the following tracts or parcels of land (the “Land”): All that tract or parcel of land situate, lying and being in the 215th and 440th G. MISCELLANEOUS gpn05 REQUEST FOR QUALIFICATION AND COST PROPOSAL FOR MODIFICATION TO CLOSURE POST CLOSURE CARE PLAN The Stephens County Board of Commissioners is soliciting statement of qualifications and cost proposal from professional engineers capable to serve as design engineers for a modification to the county’s Construction Demolition Landfill Closure-Post Closure Care Plan. The proposals submitted should be clearly marked on envelope or package ‘Stephens County Department of Solid Waste and submitted to Stephens County Clerk, 37 West Tugalo Street, Toccoa, Georgia 30577. The engineering firm shall submit its statement of qualification and cost proposal to Stephens County no later than Wednesday, March 24, 2010 at 5:00 PM, and submitted proposals will be opened in public Friday, March 26th at 10 a.m. Proposals shall be good for 90 days from date of opening. Only written proposals shall be accepted. The county reserves the right to reject any or all proposals and not to award the contract if deeded appropriate under the circumstances. The engineering firm shall provide a certificate of insurance with its proposal proving workers compensation coverage, general liability coverage, general liability coverage (minimum of $1,000,000) and professional liability insurance coverage. The county represents that the funds are available for the engineering phase of this project. After review and identification of an acceptable proposal, the proposal will be placed on the agenda of the next regular commission meeting for consideration.
